1. Scope and Acceptance

These General Terms and Conditions (hereafter "Terms") apply to all users of the website www.annamorgantailoring.com and govern all orders and transactions made through this site. By accessing or using this website, you agree to be fully bound by these Terms, regardless of whether you create an account or make a purchase. If you do not accept these Terms, please do not use this website.

These Terms are provided in both German and English. The current version is always available on our website. Please review them regularly.

2. Legal Definitions

- Consumer: Any natural person entering into a transaction for personal purposes, not primarily connected to their trade or profession.

- Anna & Morgan: Anna & Morgan, Frankenstraße 152, 90461 Nuremberg, Germany, acting in a commercial or professional capacity.

- Conflicting or additional terms provided by users or business partners will not apply unless expressly agreed to by Anna & Morgan in writing.

4. Services and Product Information

The products displayed on our website do not constitute a legally binding offer but are an invitation to place an order.

A binding contract is only formed once we send you a formal Order Confirmation via email.

Contracts are concluded in either English or German.

After placing an order, your order details will be stored. If you lose access to them, please email us at dany@annamorgantailoring.com and we will send you the documentation again.

Our products include made-to-measure clothing for men and women, with customizable options. While we strive to accurately display colors and materials on screen, variations due to monitor settings or production methods may occur.

Product availability may vary. If a selected fabric or model is unavailable, we will notify you and, where possible, offer an equivalent alternative.

5. Order Process

- Upon browsing our website and selecting the products you wish to purchase, our online system will guide you through the complete ordering procedure step by step. Please follow the instructions provided on each page to ensure your order is placed correctly.

- Orders are processed only upon receipt of full payment.

- We only accept quantities considered typical for personal use. For larger orders, please contact us.

- You must be at least 18 years old to place an order.

6. Right of Withdrawal (Consumers Only)

There is no right of withdrawal for made-to-measure or clearly customized products as per §312g Abs. 2 Nr. 1 BGB (German Civil Code).

We do NOT keep items in stock. Even for standard sizes (e.g. XS to XXL), each piece is made to order and not immediately available. Production begins only after full payment is received and you have received our official order confirmation by email. As these items are customized, they are non-returnable.

For non-customized items, you may withdraw within 14 days of delivery, provided the goods are unused, undamaged, complete, and in the original sealed packaging. Return shipping is at your own risk and cost.

7. Pricing and Taxes

- All prices are in EUR and include VAT (where applicable).

- For deliveries outside the EU, customs duties, taxes, or other fees may apply and are your sole responsibility.

- For customers outside Europe, we recommend ordering multiple items together to reduce shipping costs.

Shipping costs:

- Free shipping for orders above €350 (goods value) within the EU and EFTA.

- Orders below this threshold incur a flat shipping fee of €15.

- International shipping via DHL will be calculated by weight and destination and shown before checkout.

8. Delivery Times

Our production and delivery timeline is typically 3–4 weeks from order confirmation, depending on the season. During peak times (e.g., holidays), this may vary. You will be notified of any delays.

The stated delivery date is an estimate. External factors beyond our control (e.g. customer unavailability, weather conditions, incorrect order details, public holidays) may cause delays.

All shipments are handled via DHL. Delivery to certain countries may not be possible.

Note on U.S. Deliveries:

Currently, we do not ship to the USA due to high import tariffs. If you are willing to cover the extra costs, please contact us for exceptions: dany@annamorgantailoring.com

9. Warranty and Complaints

If your product has defects, notify us within 7 calendar days of receipt, including:

- Your order number

- A brief issue description

- Photographic documentation

If the complaint is valid, we offer:

- Free replacement with the same product

Changes to the fabric are free of charge if the original fabric is out of stock.

- Optional design/fabric changes (subject to 20% surcharge + material difference)

- Refunds or discounts (where applicable)

Anna & Morgan reserves the right to refuse replacement production if the Customer fails to cooperate by providing the information requested for such reproduction.

As each product is 100% individually tailored and handcrafted, we do not offer refunds. This is standard practice for made-to-measure items, as they have no resale value. However, we are happy to offer a free remake in any case.

10. After-Sales and Damaged/Missing Deliveries

Report delivery issues (damaged parcels, missing items) within 7 days of receiving the shipment.

11. Changes / Cancellations

Anna & Morgan allows changes or cancellations to an order only if requested in writing within 24 hours of payment. After this period, Anna & Morgan does not offer the possibility to cancel an order, as production will have already begun and non-refundable costs will have been incurred.

12. Modifications and Website Accuracy

Anna & Morgan may update or modify the website and its content without prior notice. While we strive for accuracy, we do not guarantee that all information is current, complete, or free of errors.

13. Exclusion Rights

Anna & Morgan reserves the right to refuse or withdraw access to the Website and/or services offered without notice on its own or a third party, to users, who violate these Terms and Conditions.

14. Intellectual Property

All website content — texts, designs, logos, images, and software — is the intellectual property of Anna & Morgan and may not be copied, used, or reproduced without prior written permission.

You may use the website only for private, non-commercial purposes.

15. User Obligations

You agree to:

- Provide accurate and up-to-date information

- Not misuse or disrupt the website

- Not upload harmful content (e.g., viruses)

- Not engage in unlawful, defamatory, or offensive behavior

- Not impersonate others

- Not infringe third-party intellectual property rights
